When you engage subcontractors, the priority is protection against subcontractor liability (Nachunternehmerhaftung, § 14 AEntG) and covert employee leasing (verdeckte Arbeitnehmerüberlassung). FAQ
Engagements are based on Werkverträge (BGB/VOB) for a specifically defined piece of work. The subcontractor works on its own responsibility under its own site supervision and uses its own machines and tools. The right to issue instructions remains with the subcontractor’s foreman.
To avoid the 15% tax deduction, we provide the brokered subcontractor’s valid tax exemption certificate (Freistellungsbescheinigung, § 48b EStG) before the first invoice is issued. This releases the client from the withholding obligation in a legally secure way.
Billing is at a fixed price based on site measurements, square meters, tonnage, or lump-sum trade prices according to the bill of quantities, for a clearly defined scope of work.
In each of the subcontractor’s crews, at least one person speaks German.
Subcontractors arrive as independent specialist companies with their own company vehicles, special tools, measuring equipment, and complete personal protective equipment (PPE).
Notices of defects are handled directly under the contractual warranty. If a subcontractor drops out for capacity reasons, a replacement subcontractor is provided within 48 to 72 hours.
